Introduction

Welcome to the MakeBusinessAI Affiliate Program (the „Program”). MakeBusinessAI („we,” „us,” or „the Company”) operates this Program to allow independent individuals and businesses („Affiliates”) to earn commissions by referring customers to our digital products, including AI ebooks, AI tools, AI templates, automation products, and educational digital resources sold through our website.

These Terms and Conditions („Terms”) govern your participation in the Program and form a legally binding agreement between you and MakeBusinessAI. By registering as an Affiliate, clicking „I Agree,” or participating in the Program in any way, you confirm that you have read, understood, and agree to be bound by these Terms in full.

If you do not agree to these Terms, you must not register for or participate in the Program.

Eligibility Requirements

To participate in the MakeBusinessAI Affiliate Program, you must meet the following requirements:

• You must be at least 18 years of age or the legal age of majority in your jurisdiction.
• You must have a valid and active website, blog, email newsletter, social media presence, or other legitimate promotional channel.
• You must be legally authorized to enter into this agreement in your country of residence.
• You must not be a current employee, contractor, or immediate family member of a MakeBusinessAI employee.
• You must operate in compliance with all applicable local, national, and international laws and advertising regulations, including but not limited to FTC guidelines, GDPR, and CAN-SPAM.
• Your promotional channels must not promote illegal activity, hate speech, adult content, or content that conflicts with MakeBusinessAI’s values.
• You must not have previously been removed from the Program due to policy violations.

MakeBusinessAI reserves the right to determine eligibility at its sole discretion and to reject any application without stating a specific reason.

Affiliate Registration and Approval

To join the Program, you must submit a complete application through our affiliate registration page, powered by SliceWP on our WordPress/WooCommerce platform. The application requires accurate and complete information about you and your promotional methods.

• All applications are reviewed manually. Submission does not guarantee acceptance.
• We will notify you by email of the outcome of your application. Approval or rejection may occur at any time.
• You are responsible for keeping your account information accurate and up to date, including your payment details.
• You must not create multiple affiliate accounts. Duplicate accounts will be terminated.
• You may not transfer, sell, or assign your affiliate account to any other person or entity.
• MakeBusinessAI reserves the right to suspend or terminate your account at any time if we determine that any information provided was false, misleading, or incomplete.

Affiliate Responsibilities

As an Affiliate, you are solely responsible for your promotional activities. You agree to the following:

• Promote MakeBusinessAI products honestly, accurately, and professionally in a manner consistent with these Terms.
• Comply with all applicable laws, including advertising disclosure requirements. You must clearly disclose your affiliate relationship in all promotional materials (e.g., „This post contains affiliate links. I may earn a commission if you make a purchase.”).
• Not make false, exaggerated, or misleading claims about any MakeBusinessAI product, its results, or its features.
• Not make income guarantees or unrealistic earnings claims on behalf of MakeBusinessAI.
• Not create fake testimonials, fake reviews, or fabricated case studies.
• Not create fake discount codes, fake coupons, or false limited-time offers that do not officially exist.
• Not impersonate MakeBusinessAI, its staff, or its official communications.
• Not use our brand name, logo, or copyrighted materials without prior written permission.
• Promptly notify us of any content errors, broken links, or customer complaints related to your promotions.

Prohibited Promotional Methods

The following promotional methods are strictly prohibited and will result in immediate account termination and forfeiture of all pending commissions:

• Spam — Sending unsolicited bulk emails, messages, or comments to promote your affiliate link.
• Fake or Bot Traffic — Using bots, click farms, automated scripts, or any other artificial means to generate clicks, impressions, or referrals.
• Coupon Abuse — Listing your affiliate link on coupon websites, deal sites, or cashback platforms without our express written permission.
• Cookie Stuffing — Artificially placing affiliate cookies on a user’s device without their knowledge or genuine interaction.
• Trademark Bidding — Bidding on MakeBusinessAI branded keywords in paid advertising platforms (see Section 8).
• Misleading Redirects — Using cloaked links, deceptive pop-ups, or forced redirects to mislead users into clicking affiliate links.
• Incentivized Clicks — Offering cash, points, or rewards to users specifically for clicking your affiliate link.
• Self-Referrals — Purchasing through your own affiliate link (see Section 18).
• Negative SEO or Comparative Attacks — Creating content that falsely attacks competitors or spreads misinformation to benefit MakeBusinessAI.
• Content on Illegal or Harmful Websites — Placing affiliate links on websites promoting illegal activities, adult content, or harmful material.

Spam Policy

MakeBusinessAI has a zero-tolerance policy for spam. Spam includes any unsolicited bulk communication sent via email, SMS, social media messages, comment sections, forums, or any other channel.

• You must never send unsolicited promotional messages containing your affiliate link.
• You must never post affiliate links in unrelated forums, comment sections, or communities where such promotions are not permitted.
• You must comply fully with the CAN-SPAM Act, GDPR, and all other applicable anti-spam laws.
• Any report of spam activity associated with your affiliate account will be investigated and may result in immediate account suspension.

If a third party contacts MakeBusinessAI to report spam from an affiliate, we reserve the right to terminate that affiliate’s account immediately and report the activity to the appropriate authorities.

Paid Advertising Rules

Affiliates may use paid advertising to promote MakeBusinessAI products, subject to the following conditions:

• All paid advertising must comply with the policies of the advertising platform being used (Google Ads, Meta Ads, etc.).
• You must not bid on branded keywords or trademark terms (see Section 8).
• Your ad copy must be accurate and not misleading. No false claims, fake urgency, or fabricated discounts.
• Paid ads must not impersonate MakeBusinessAI or suggest official endorsement from the company.
• Paid ads must link to your own content (blog post, review page, etc.) or directly to MakeBusinessAI through your tracked affiliate link — not to any deceptive landing page.
• MakeBusinessAI reserves the right to request the removal of any paid advertising campaign that violates these Terms.

Brand Keyword Restrictions

To protect the integrity of our brand and marketing efforts, the following keyword bidding restrictions apply to all affiliates using paid advertising:

• You must not bid on the keywords „MakeBusinessAI,” „Make Business AI,” or any misspellings or variations of our brand name in any paid search platform.
• You must not use our brand name in the headline, display URL, or primary text of any paid advertisement.
• You must not create ad campaigns that appear in search results when users search for our brand, products, or website directly.
• You must not use our brand name in any domain name, subdomain, or social media handle without prior written consent.

Violations of brand keyword restrictions will result in immediate termination of your affiliate account and forfeiture of all commissions.

Social Media Promotion Rules

You are welcome to promote MakeBusinessAI products on social media platforms, including but not limited to YouTube, Instagram, TikTok, X (Twitter), Facebook, LinkedIn, and Pinterest. The following rules apply:

• All promotional posts must include a clear and conspicuous affiliate disclosure in accordance with FTC guidelines and the rules of the platform you are using.
• You must not create fake personas or accounts to promote affiliate links.
• You must not post spam or repetitive promotional content in groups, communities, or comment sections.
• You must not use paid social media ads that impersonate MakeBusinessAI or create the impression that the content is official company communication.
• You must not make income claims or promise specific results to your audience (e.g., „This course made me $10,000 in a month” without factual, verifiable proof).
• Any social media content found to be misleading, deceptive, or in violation of platform policies will be considered a violation of these Terms.

Email Marketing Rules

Email marketing is permitted only when conducted in full compliance with applicable laws and these Terms:

• You may only send promotional emails to individuals who have explicitly opted in to receive communications from you.
• All emails must include a functioning unsubscribe mechanism and your valid physical or business mailing address.
• Emails must comply with the CAN-SPAM Act, GDPR, CASL, and all other applicable regulations in your jurisdiction.
• You must not send emails that misrepresent you as MakeBusinessAI or use our brand in your „From” name or email address in a way that implies official communication.
• Misleading subject lines, false sender names, or deceptive preview text are strictly prohibited.
• You must not purchase email lists or use scraped contact data for promotion.

Commission Structure

Affiliates earn commissions on verified, successful purchases made through their unique affiliate tracking link, within the cookie window. The current commission structure is displayed in your affiliate dashboard and on the Program information page.

MakeBusinessAI reserves the right to modify commission rates, structures, and eligible products at any time. Changes will be communicated via email and/or your affiliate dashboard. Continued participation after such notification constitutes acceptance of the new rates.

Commissions are only earned on qualifying purchases. Commissions are not earned on:

• Purchases made using your own affiliate link (self-referrals)
• Purchases that are subsequently refunded or charged back
• Purchases generated through fraudulent, spammy, or prohibited traffic
• Purchases where tracking data is unavailable or untraceable due to ad blockers or user settings

Commission Approval Process

All commissions go through a review and approval period before becoming eligible for payout. This period allows us to verify the validity of each referral and account for potential refunds or disputes.

• Commissions are placed in „Pending” status immediately upon a qualifying referral being recorded.
• After a review period of up to 30 days from the date of purchase, eligible commissions are moved to „Approved” status.
• Approved commissions become payable according to the payout schedule (see Section 15).
• Commissions may be rejected if the sale is found to involve fraud, spam, a self-referral, a policy violation, or if the sale is refunded during the review period.

MakeBusinessAI makes all commission approval decisions at its sole discretion. Approved commissions are final unless fraud is discovered at a later date, in which case they may be reversed.

Refunds and Chargebacks

If a customer who purchased through your affiliate link receives a full or partial refund, or initiates a chargeback, the corresponding commission will be deducted or reversed accordingly.

• If the commission has not yet been paid out, it will be removed from your pending or approved balance.
• If the commission has already been paid out, the amount will be deducted from a future payout. If your balance is insufficient, MakeBusinessAI reserves the right to request repayment of the outstanding amount.
• Affiliates have no right to commissions on refunded or charged-back transactions, regardless of when the refund occurs.

Commission Reversals

MakeBusinessAI reserves the right to reverse commissions in the following circumstances:

• The associated purchase was refunded, disputed, or charged back.
• The referral was identified as a self-referral.
• The commission was generated through fraudulent activity, fake traffic, bots, or prohibited methods.
• The affiliate is found to have violated these Terms at any point before or after the purchase.
• The purchase is determined to be invalid for any other reason at MakeBusinessAI’s discretion.
• Technical errors resulted in an incorrect commission being recorded.

Commission reversals may occur at any time, including after an initial payout has been made, if fraud or violation is discovered retrospectively.

Payout Terms

Approved commissions are paid out according to the following terms:

• Payouts are processed monthly, typically within the first 15 days of each calendar month for the previous month’s approved commissions.
• Payouts are only processed if your account balance meets the minimum payout threshold (see Section 16).
• Affiliates are responsible for providing accurate and up-to-date payment information in their affiliate dashboard. MakeBusinessAI is not responsible for failed payments due to incorrect information provided by the affiliate.
• Available payout methods are detailed in your affiliate dashboard and may include PayPal, bank transfer, or other methods at MakeBusinessAI’s discretion.
• All payouts are made in USD unless otherwise agreed in writing.
• MakeBusinessAI is not responsible for any currency conversion fees, bank fees, or third-party transaction fees incurred by the affiliate upon receiving payment.

Minimum Payout Threshold

A minimum account balance of $100 USD is required before a payout will be processed.

• If your balance does not reach $100 USD in a given month, your earnings will carry forward to the following month and continue accumulating until the threshold is met.
• There is no maximum to the amount that can be paid out in a single period.
• Balances that remain below the threshold for an extended period will continue to accumulate without expiry, provided your account remains in good standing.
• If your affiliate account is terminated, any balance below the minimum payout threshold may be forfeited at MakeBusinessAI’s discretion.

Cookie Duration

MakeBusinessAI uses a 90-day cookie window to track affiliate referrals. This means that if a visitor clicks your affiliate link and makes a purchase within 90 days of that click, you will receive credit for the sale.

• The 90-day window begins from the moment the user first clicks your affiliate link.
• If a user clicks multiple affiliate links from different affiliates, the last-click attribution model applies — the most recent affiliate link clicked before purchase will receive the commission.
• Cookies may be cleared by the user or blocked by browser settings, ad blockers, or privacy tools. MakeBusinessAI is not responsible for lost commissions resulting from cookie deletion or blocking.
• Cookie duration is subject to change. Affiliates will be notified of any changes via email or the affiliate dashboard.

Self-Referrals Prohibited

Self-referrals are strictly prohibited. A self-referral occurs when you use your own affiliate link to purchase any MakeBusinessAI product — whether for yourself, using an account in your own name, a family member’s account, a business account you control, or any other account that benefits you directly or indirectly.

• Any commissions identified as self-referrals will be immediately reversed and voided, regardless of whether they have been paid out.
• Repeated self-referrals will result in permanent account termination and potential legal action to recover amounts already paid.
• Affiliates suspected of self-referral activity may have their accounts suspended pending investigation.

Fraudulent Activity

MakeBusinessAI actively monitors all affiliate activity for signs of fraud. Fraudulent activity includes, but is not limited to:

• Generating fake clicks, impressions, or referrals through automated tools, bots, or scripts.
• Creating fake customer accounts to generate commissions.
• Encouraging others to click your affiliate link without genuine interest in purchasing.
• Cookie stuffing or other forms of unauthorized tracking manipulation.
• Colluding with other affiliates or third parties to generate invalid commissions.
• Using stolen payment methods or identities to complete purchases.

If fraudulent activity is detected, MakeBusinessAI will:

• Immediately suspend and permanently terminate the affiliate account.
• Reverse all commissions generated through fraudulent activity, including those already paid out.
• Reserve the right to pursue legal action and recover all damages incurred.
• Report the activity to relevant authorities where required by law.

Intellectual Property

MakeBusinessAI grants you a limited, non-exclusive, non-transferable, revocable license to use our approved promotional materials — including approved logos, banners, and copy — solely for the purpose of promoting the Program in accordance with these Terms.

• You may not modify, alter, or create derivative works of any MakeBusinessAI branding, logos, or content without prior written permission.
• You may not use our intellectual property in any way that implies partnership, ownership, or official endorsement beyond your affiliate relationship.
• You may not register domain names, trademarks, or social media handles that incorporate our brand name or any confusingly similar variation.
• All intellectual property rights in MakeBusinessAI’s products, brand, and content remain exclusively with MakeBusinessAI.
• Upon termination of your affiliate account, your license to use our branding and promotional materials is immediately revoked.

Termination of Affiliate Accounts

MakeBusinessAI reserves the right to suspend or terminate any affiliate account at any time, with or without notice, for any of the following reasons:

• Violation of any provision of these Terms.
• Fraudulent, deceptive, or harmful promotional activity.
• Spam complaints or violation of anti-spam laws.
• Generating low-quality, invalid, or fraudulent traffic.
• Failure to comply with advertising regulations or legal requirements.
• Conduct that may damage the reputation or business interests of MakeBusinessAI.
• Account inactivity for an extended period, at MakeBusinessAI’s discretion.
• Any other reason deemed appropriate by MakeBusinessAI.

Upon termination, all pending and approved commissions that have not yet been paid may be forfeited if the termination is due to a violation of these Terms. Commissions earned in good faith prior to termination may, at MakeBusinessAI’s sole discretion, be paid out after the standard review period.

You may also terminate your own participation at any time by contacting us and requesting account closure.

Right to Reject Affiliates

MakeBusinessAI reserves the right to refuse or revoke affiliate status to any individual or entity at any time, for any reason, without being required to provide an explanation. This includes, but is not limited to:

• Applicants whose promotional channels do not align with MakeBusinessAI’s brand values.
• Applicants who have previously violated these Terms or been removed from the Program.
• Applicants whose websites or channels promote content that MakeBusinessAI considers inappropriate, harmful, or reputationally damaging.
• Existing affiliates whose promotional activities have been found to violate these Terms at any point.

Limitation of Liability

To the maximum extent permitted by applicable law, MakeBusinessAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your participation in the Affiliate Program, including but not limited to:

• Loss of income, revenue, or anticipated profits from the Program.
• Loss of data, business, or goodwill.
• Changes to commission rates, program terms, or product availability.
• Technical failures, tracking errors, or platform downtime.
• Actions taken by MakeBusinessAI in connection with suspected fraud or policy violations.

In no event shall MakeBusinessAI’s total cumulative liability to any affiliate exceed the total commissions paid to that affiliate in the three (3) months immediately preceding the event giving rise to the claim.

The Affiliate Program is provided „as is” without warranties of any kind. MakeBusinessAI does not guarantee any specific level of earnings, traffic, or results from participation in the Program.

Relationship of Parties

Your participation in the MakeBusinessAI Affiliate Program does not create an employment, partnership, joint venture, agency, or franchise relationship between you and MakeBusinessAI.

• You are an independent contractor. You are not an employee, agent, or representative of MakeBusinessAI.
• You have no authority to bind MakeBusinessAI to any agreement, make commitments on our behalf, or represent that you act on behalf of MakeBusinessAI.
• As an independent contractor, you are solely responsible for all taxes, insurance, and other obligations arising from your earnings as an affiliate in your country or jurisdiction.
• MakeBusinessAI is not responsible for providing any employee benefits, workers’ compensation, or similar entitlements.

Modification of Terms

MakeBusinessAI reserves the right to modify, update, or replace these Terms at any time, including changes to commission rates, cookie duration, payout thresholds, eligible products, and prohibited activities.

• Changes to these Terms will be communicated to affiliates via email and/or a notification in the affiliate dashboard.
• The updated Terms will take effect on the date specified in the notification, or immediately upon posting if no date is specified.
• Your continued participation in the Program after the effective date of any change constitutes your acceptance of the revised Terms.
• If you do not agree to any modification, you must stop participating in the Program and notify us to close your account.

We encourage you to review these Terms periodically to stay informed of any updates.

Final Agreement

These Terms and Conditions constitute the entire agreement between you and MakeBusinessAI with respect to your participation in the Affiliate Program and supersede all prior agreements, representations, or understandings relating to the same subject matter.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under or in connection with these Terms shall be resolved through good faith negotiation. If resolution cannot be reached, disputes shall be submitted to the appropriate courts of competent jurisdiction.

By registering for or participating in the MakeBusinessAI Affiliate Program, you confirm that:

• You are at least 18 years of age.
• You have the legal authority to enter into this agreement.
• You have read and understood these Terms in their entirety.
• You agree to comply with all provisions outlined herein.
